Does Malevay Studios EULA breach Privacy Laws and Linden Labs TOS ?

Rory Serpente's picture

Part 6, the final section of the Malevay Studios EULA (available on the Malevay Studios web site at http://www.worldofmeeroos.com/EULA.php )states in full -

6. LIMITATION OF LIABILITY
In no event shall Malevay Studios be liable for any damages (including, without limitation, lost profits, business interruption, or lost information) rising out of 'Authorized Users' use of or inability to use the Meeroos Brand Products, even if Malevay Studios has been advised of the possibility of such damages. In no event will Malevay Studios be liable for loss of data or for indirect, special, incidental, consequential (including lost profit), or other damages based in contract, tort or otherwise. Malevay Studios shall have no liability with respect to the content of the Meeroos Brand products or any part thereof, including but not limited to errors or omissions contained therein, libel, infringements of rights of publicity, privacy, trademark rights, business interruption, personal injury, loss of privacy, moral rights or the disclosure of confidential information.

My concern is the loss of privacy, moral rights or the disclosure of confidential information. section.

Is this

1. simply another piece of what in my opinion is a poorly written document?

OR

2. an attempt by Malevay Studios to avoid all privacy laws including those forming the Linden Labs TOS?

If the answer is 2. does this mean Malevay Studios have, are or intend to either use for their own purposes not associated with Meeroos and/or sell to 3rd parties any or all of the private and confidential information obtained via the Meeroos and currently held on their database?

Please note I am not making any accusation nor casting any doubts about the integrity of Malevay Studios and/or their Directors, personal, staff, share-holders and the like.

I am simply asking what I consider a very serious question in relation to both national and international privacy laws, and one which I believe Malevay Studios need to answer quickly and prominently on the front page of their web-site.
